Navigating CMS Reporting Requirements for COVID-19 Cases

On May 6th, the CMS released their Interim Final Rule updating requirements for notification of confirmed and suspected COVID-19 cases among residents and staff in nursing homes. As a result, the Centers for Medicare & Medicaid Services is requiring nursing homes to report any COVID-19 cases directly to the Centers for Disease Control and Prevention (residents or staff). Importantly, there is also a mandate that facilities notify residents, families and representatives of all COVID cases — or risk enforcement actions. 

What you need to know.

As part of this new reporting mandate, “nursing homes must inform residents and their representatives within 12 hours of the occurrence of a single confirmed infection of COVID-19, or three or more residents or staff with new-onset respiratory symptoms that occur within 72 hours.” 

“Nursing homes are unique because they’re not only health care providers – they are permanent homes for over 1.3 million people.”

Therefore, CMS worked closely with the CDC to identify areas the virus may strike and targeted their inspections correspondingly. The decision was made to focus the inspections on the most immediate needs, ensuring safety while not compromising patient care.

While CMS noted the CDC will be providing a reporting tool to nursing homes to “support Federal efforts to collect nationwide data to assist in COVID-19 surveillance and response.” It has been left up to the facilities to develop methods to notify residents, their families and representatives to meet Center for Medicare and Medicaid Services Program’s 42 CFR §483.80(g) guidelines.
